What this system is

The Cape 31 Class Management System ("CMS") at cms.cape31class.org is an internal administration tool operated by the Cape 31 International Class Association ("the Association") for the sole purpose of managing class membership, boat registration, regatta entries, crew categorisation, race results, and class communications.

Access to the CMS is granted exclusively to registered members of the Cape 31 class — boat owners, captains, crew, race officers, yacht club administrators, and class officials — as determined by the Association. It is not a public service.

2

Eligibility and access

Access is granted by the Association at its discretion. To use the CMS you must:

— Be a current or prospective member of the Cape 31 class, or an official acting in a recognised capacity on behalf of the class or a member yacht club.

— Provide accurate personal information when registering. You are responsible for keeping your details up to date, including your World Sailing sailor ID and category declaration.

— Keep your login credentials secure. You are responsible for all activity carried out under your account.

The Association may grant, suspend or revoke access at any time, with or without notice, where it considers this necessary for the proper administration of the class.

3

Acceptable use

By using the CMS you agree to use it only for its intended purpose — class administration — and to act in good faith and in accordance with the Cape 31 Class Rules and the Cape 31 Class Constitution.

You must not: submit false or misleading information (including false World Sailing category declarations); attempt to access accounts or data belonging to other users; interfere with the operation of the system; or use the CMS for any commercial purpose unrelated to your participation in the Cape 31 class.

World Sailing category declarations are made on your honour. Submitting a false amateur (Category 1) declaration is a breach of the World Sailing Sailor Classification Code and Cape 31 Class Rules, and may result in disqualification, loss of results, and referral to World Sailing.
4

Data and privacy

Your use of the CMS involves the collection and processing of personal data as described in our Privacy Notice. By using the CMS you acknowledge that you have read and understood the Privacy Notice.

Race results, including names and finishing positions, form part of the permanent sporting record of the class and will be retained and may be published in accordance with normal sporting practice.

When you add crew members to a regatta entry, you confirm that those individuals have consented to their personal data being submitted to the class for the purposes of race administration.

5

Availability and changes

The CMS is provided on a reasonable-efforts basis. The Association does not guarantee uninterrupted availability and accepts no liability for losses arising from system downtime, data errors, or technical failures, except where required by applicable law.

The Association reserves the right to modify, suspend or discontinue any part of the CMS at any time. Where changes affect members' obligations or rights, reasonable notice will be given via the CMS or by email.

These Terms of Service may be updated from time to time. The effective date shown above indicates when they were last revised. Continued use of the CMS after any update constitutes acceptance of the revised terms.

6

Governing law

These Terms of Service are governed by the laws of England and Wales. Any disputes arising from use of the CMS shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory local law requires otherwise.
